Rav Ghuman

Sears - Rav was informed by a number of technicians that at a recent meeting they were told by a manager that Sears does not pay any amount of money towards a medical certificate. The manager who relayed this information is incorrect, as under certain conditions Sears is obligated to pay a limited amount. Article 18.04 of the collective agreement states “Where management request a medical certificate for absences of under five (5) days, the Company will reimburse the associate up to a maximum of twenty dollars ($20.00) upon proof of payment”. This was confirmed by Julia Mogridge (Human Resources) at a labour management meeting held January 18th.

SPUD - The Union has filed a grievance alleging SPUD has contravened Articles 13.1 and 14.6 by not awarding the posted position of “Invoice Clerk” to the senior applicant. Article 14.6 states in part “job awards shall be made on the basis of, abilities, qualifications, demonstrated performance and seniority, in that order.” The Company claims the junior applicant scored much higher in all three categories. Rav has asked SPUD to provide the union with the following information: What test or tests were used to make a determination of who scored higher; was an interview process held and if so, when and by whom; the adequacy of the opportunities for preparation given to prospective applicants; the way in which the test was administered; the reliability of the marking; and the relevance of the content of the test to the posted position. The union is currently awaiting a response from the Company.
